LAWS REGARDING TRADE OF MARINE SPECIES

Honduran Laws:

1) EXECUTIVE DECREE 002-2004: RULES FOR THE CONTROL OF DEVELOPMENT IN THE BAY ISLANDS

Article 29.
It is forbidden to hunt and/or trade any flora or fauna species that are endangered, especially black coral and sea turtles; this includes every sub-product or handcraft made out of them.

 

2) MUNICIPAL LAW: MUNICIPALITY OF ROATAN BYLAWS (ADENDUM) - Chapter II of the prohibitions.

Article 49. The following is forbidden:
1) The exploitation, extraction, or use of the coral and similar elements of the ocean and beach;

2) The act of fishing or exploitation of the marine reserve areas declared by the municipality;

3) The hunting or trading of protected or endangered species, specially turtles, parrots, crocodiles, and deer.

 

3) HONDURAN FORESTRY, PROTECTED AREAS, AND WILDLIFE LAW

Article 116. Trade of wild flora and fauna.
Exportation or importation activities of wild animals and plants will be subjected to the dispositions provided by international agreements signed by Honduras regarding the subject, ecological conditions of the area, and existing regulations.

International agreements ratified by Honduras:

CONVENTION ON INTERNATIONAL TRADE IN ENDANGERED SPECIES OF WILD FAUNA AND FLORA (CITES)

CITES is an international agreement between governments, ratified by Honduras in 1985. Its aim is to protect endangered specimens of wild animals and plants from international trade.

CITES prohibits the international trade of threatened or endangered specimens, unless it is done with non commercial purposes.

The following are CITES species:

Hawksbill Turtle (Chelonia mydas)
CITES Appendix I
IUCN Redlist - Critically Endangered

Queen Conch (Strombus gigas)
CITES Appendix II

Seahorses (Hippocampus spp.)
CITES Appendix II

Black Coral (Antipatharia spp.)
CITES Appendix II

Stony Corals (Scleractinia spp.)
CITES Appendix II

 

INTER-AMERICAN CONVENTION FOR THE PROTECTION AND CONSERVATION OF SEA TURTLES

The Inter-American Convention for the Protection and Conservation of Sea Turtles (“IAC”) is an intergovernmental treaty which provides the legal framework for countries in the American Continent to take actions in benefit of these species.

Article 4.
1. Each Party shall take appropriate and necessary measures, for the protection, conservation and recovery of sea turtle populations and their habitats.

2. Such measures shall include:
Compliance with the obligations established under the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) relating to sea turtles, their eggs, parts or products.
